We offer billing alternatives

Rylander & Associates PC provides flexibility to clients by offering not only the traditional hourly billing structure, but also alternative billing structures that fit different client needs including predictability and risk management. We actively seek to promote efficiency. We include the option in our prosecution practices for fixed fee plus cost patent and trademark prosecution on a disclosure by disclosure basis. The Firm also remains open to considering different options for billing structure to meet specific client needs. In all cases, however, billing structure engagements will be agreed in advance and confirmed in writing. Moreover, in all cases the client remains liable for costs as they are incurred and/or expended.

Hourly

The client engages the Firm, usually with a retainer deposit and is billed generally monthly based on the hourly rates for the time spent during the billing period.

Fixed Fee

The client and the Firm agree on a fixed price for prosecution of a patent or trademark applicatoin based on the client disclosure and the matter complexity and the client pays that amount up front. The client does not pay any further hourly fees for the matter.

Milestone

The client and the Firm agree on a series of milestone payments for the particular matter, and then the client is invoiced and payment is made at each milestone.  This can include matters, such as litigation, where  a set monthly fee is agreed to.

Contingency 

For litigation with positive claims for damages, in some cases the Firm will consider taking a case on contingency plus cost basis, which means that the Firm’s fee for time spent will be a percentage of a recovered amount.

Split Contingency 

For litigation with positive claims for damages, in some cases the Firm will consider taking a case on split contingency basis, which means that the Firm will bill and invoice for fees at the normal hourly rate, but the client will only pay a percentage of the fees billed, and the Firm will get a percentage of any recovered amount.

Success Fee

For litigation with no or nominal positive claims for damages, such as in a defense, agreed in writing in advance between the Firm and the client, the Firm will consider defending a client on a success fee basis, which means that the Firm will bill and invoice for fees at the normal hourly rate, but the client will only pay a percentage of the fees billed, and in the event of a successful defense, the meaning of which will be defined in advance, the Firm will get an additional predetermined fee for the success.
